I could be reading to much in to this but the ONLY time I have seen a warning like that is on sites and in catalogs which also sell to farms GMO corn. I hope I am wrong but if I am not it could be serious.Idk but warnings like that...........I see red flags.

They could be trying to protect there rights on the genis of seed or like you are saying it's a GMO but I would think they would have to declare it as such. I would call Burpee and ask someone there what that agreement is all about.
I have to say that I really haven't had good results with burpee seed in my area and stopped using there products many years ago.
